Exclusive agreements: why owners resist and what helps

The resistance is almost never about the term or the commission. It is about the feeling of giving up choice and receiving a promise. Three things remove it: a term that does not frighten, a written commitment to specific actions, and a regular report. An exclusive right is given in exchange for exclusive effort, not for a signature.

What the owner actually hears

You say "exclusive agreement". They hear: "I sign for six months, and whether you do anything afterwards is anyone’s guess."

That is not unreasonable. If they have sold before, they have probably been through an agency that uploaded three phone photos, posted the listing and waited. From their side the exclusive right was one-directional — they gave, and got nothing back.

"That is how it works everywhere else" does not help. What works is showing what they get in exchange for the signature.

The three real fears

And what removes each one
  • "I will be tied up if you are not active." Removed by a term that does not frighten — three months with an option to extend rather than twelve. A short term is easier to sign and gives you a real deadline to prove yourself.
  • "I will pay commission to someone who did nothing." Removed by a written list of specific actions: professional photos, publication to named portals, number of viewings, campaign. Listed items can be checked.
  • "I will miss a buyer who would have come from elsewhere." Removed by explaining how the network between agencies works — a shared property reaches more brokers than one scattered across five agencies with no coordination.

What you commit to in return

An exclusive right is a trade, not a service. If you want one side of it, give the other — and put it in writing.

The working minimum: good photos within a stated deadline, publication to specifically named portals, a reply to every enquiry the same day, and a written report every two weeks — how many times the listing was viewed, how many enquiries, how many viewings, and what the people who saw it actually said.

Those numbers are not compiled by hand — views per portal, enquiries and viewings held live on the property itself, and the report is drawn from there.

The report is the most underrated item in the whole agreement. An owner receiving numbers every fortnight does not call to ask what is happening and does not go looking for a second agency. And when the conversation about lowering the price arrives, they arrive prepared, because they have watched twenty views turn into zero viewings themselves.

When they refuse anyway

Do not push it to the end. Work without the exclusive right, but state plainly what changes: the listing goes to fewer portals, professional photos are off the table, and there will be no report.

That is not a punishment, it is honest arithmetic — those things cost money and are done for a property that will not turn up at the neighbour’s tomorrow at a different price. Said once, without resentment, it does more than any amount of persuading. Some owners come back a month later, once they have seen the difference.

Frequently asked questions

What term is reasonable?

Three months with an option to extend is easier to sign than six or twelve, and is long enough to show a result. For atypical and expensive properties a longer term is logical, but justify it with the market rather than with custom.

Can an exclusive agreement work without a penalty clause?

It can, and it is often easier to sign. If you are confident in your work, the penalty helps you less than it hinders the signature. The choice is yours, but make it deliberately rather than by inheriting an old template.

How should the commission be explained?

As a percentage of work done, not a percentage of the price. Owners accept a figure backed by listed actions and a report far more easily than the same figure presented purely as a percentage.
